Information about Sexual Harassment
Title IX and another federal law known as Title VII both prohibit sexual harassment in an educational workplace. More significant instances of sexual harassment that take place within the University’s education program or activity will be processed through University Policy 504, Title IX Grievance Policy.
Sexual harassment that does not meet the definitions of University Policy 504 may still be covered by Title VII. Equal Employment Opportunity Commission (EEOC) guidelines define sexual harassment as follows:
Harassment on the basis of sex is a violation of Section 703 of Title VII, which states that: “Unwelcome sexual advances, requests for sexual favors, and other verbal and physical conduct of a sexual nature constitute sexual harassment when:
- Submission to such conduct is made either explicitly or implicitly a term or condition of an individual’s employment,
- Submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual, or
- Such conduct has the purpose or effect of substantially interfering with an individual’s work performance or creating an intimidating, hostile or offensive working environment.”
